Aladdin Hotel & Casino – Ron Maus
Ron performed a number of projects relating to the construction of the Aladdin. These included: 1) providing on-site verification of the existence and cost of certain materials on hand being financed through a lending institution that insisted on having authentication of such items prior to disbursements; 2) providing assistance to Aladdin ownership in the review of construction claims being made from various specialty contractors in the push to complete the project in time to meet lender requirements; 3) participating in mediations to resolve construction claims on the project; 4) preparation of a claim on behalf of the hotel and casino for permanently lost profits resulting from a fatal construction accident which created a delay to project completion and opening; and 5), evaluation of loss of profits claims made from the developer of the attached shopping mall against the hotel and casino for alleged failures on the part of the hotel and casino to live up to certain commitments affecting foot traffic in the mall.

Safeco Field – Ron Maus
Ron was initially retained by legal counsel for the Public Facilities District charged with building and leasing Seattle’s Safeco Field, home to the Mariners, to review billings under the cost-sharing agreement between the team and the PFD. After claims were received, he led a team of consultants that performed evaluations of the work of the architect and engineering firms involved in the project, as well as costs incurred by the general contractor, and certain of its subcontractors. After the PFD’s financial obligations were completed, Ron was then retained by counsel for the Mariners to provide the team with information that assisted in its being able to complete negotiations of final cost with the general contractor for the project.

Sound Transit – Ron Maus
Ron has been retained by in-house and outside counsel for Sound Transit to assist on a variety of projects, to include matters of construction claims made on a transit center; revamping of the Downtown Seattle Transit Tunnel signal control and communication system; the train operations and maintenance base; elevated structures and street level light rail track construction claims; and tunnel-related claims. Many of these projects are ongoing at the present time, but as Ron’s involvement is known to the parties with interests adverse to Sound Transit, indication of his involvement in these matters does not create any confidentiality issues.

Washington State Ferries – Ron Maus
The first claim that Ron worked on commenced in early 1982, when he was the Senior Consultant responsible for providing services to the state of Washington regarding more than $30 million of claims. He was involved in that matter until its resolution in 1985, which instead resulted in the bonding company for the shipbuilder paying the State more than $8 million. Since that time, Ron has worked on claims regarding the major refurbishment of a number of Washington State Ferry vessels, and provided assistance to the State when the three new Jumbo Mark II vessels were delivered along with $63 million of claims. He currently has been appointed to the Governor’s Expert Review Panel for the procurement of four new 144 vehicle vessels, anticipated for a total program cost in the range of $400,000,000.

Curly Fries – Ron Maus
An example of a commercial matter on which Ron worked involved a trade secret dispute between two giants of French fry production, McCain Foods Ltd. of Canada and Lamb-Weston of Richland. In this matter, Ron was retained by counsel for Lamb-Weston, which had asserted and demonstrated to the satisfaction of the Court that McCain had misappropriated its trade secrets relating to the necessary blade to produce helical-cut “curly cut” French fries. Ron was charged with determining the research and development costs of Lamb-Weston that were essentially co-opted by the defendant, the lost sales of Lamb-Weston in the Court’s determined “head start” period, and the unjust enrichment enjoyed by the defendant during that period. Ron provided successful testimony in federal court in Oregon regarding the damages sustained under the law by the plaintiff.
